Visa Requirements
Here are the requirements that are needed for the H-1B Petition.

  1. Detailed non-technical job description for current or proposed position. Describe the professional duties of the position that is the focus of the H-1B Petition in great detail, with percentages of total work time spent on completing each duty described. Please also emphasize any special skills that the employee may possess that qualify him/her for, and will be utilized by the employee in, the proposed or current position.

  2. Minimum education and experience requirements for the position. State the minimum level of education and the specialty area in which the degree must have been obtained, in addition to the years of experience that are required (not preferred) for the position. (Note that while the H-1B classification has a general requirement of the U.S. equivalent of a bachelor’s degree (through education and/or related employment experience), we require the specific degree and/or experience normally required for this particular position with your company).

  3. Base annual salary offered to the employee.

  4. Duration of the proposed employment.

  5. Marketing Materials from the company, if available. If not, submit a brief description of the company’s history, including the date of establishment, the number of employees, and the amount of gross and/or net annual income in the last fiscal year.

  6. Full official name, title and mailing address of company representative/application signatory as well as name and official title of employee’s immediate supervisor, and number of other employees to be supervised by employee (if any).

  7. Official company name's) and full addresses) of where employee will work in U.S.

IMR’s visa department & INS Premium Processing Service

To Speed Processing Times

On June 1, 2001, the INS enacted its Premium Processing Service, which promises to speed up the agency’s application decision process on selected work visas. Under the new program, paying an additional $1000 fee will guarantee an INS decision on eligible temporary work visas within 15 calendar days of the receipt of the application by the INS. Typical processing times currently run two to four months for most work visas.

This new Premium Processing Service puts even greater emphasis on the time it takes to immigration service providers to prepare the documents for the INS. To prepare your applications in conjunction with the Premium Processing Service ensures that you get the fastest end-to-end immigration processing available.

Which Visa Categories Can Be Expedited

The following categories are now eligible for the Premium Processing Service:

  • E-1 and E-2: Treaty traders and investors.

  • H-2A: Temporary or seasonal agricultural workers for areas where U.S. agricultural workers are unavailable.

  • H-2B: Workers engaging in non-agricultural employment which is seasonal, intermittent, to meet a peek load need, or for a one-time occurrence where U.S. workers are unavailable.

  • H-3: Workers coming to the U.S. to receive specialized training that is not available in their home country.

  • L-1A: Managerial or executive-level employees of a foreign company coming to work at the U.S. branch of that company.

  • L-1B: An employee of a foreign company with specialized knowledge coming to work at the U.S. branch of that company.

  • O-1 and O-2: Individuals with extraordinary ability in the sciences, arts, education, business, or athletics, or with a record of extraordinary achievement in television or motion pictures.

  • P-1, P-2, and P-3: Athletes and entertainers.

  • Q-1: Participants in an international cultural exchange program in the U.S. that provides practical training, employment, or the sharing of foreign culture.

As of July 30, 2001, the INS will add the H-1B (specialty occupations), R-1 (religious workers) and TN (Canadian or Mexican professionals) to the Premium Processing Service. Following that, more categories may be added.

How the Program Works

To request premium processing, a special form and a separate check for the additional $1000 must accompany the immigration application. Once the appropriate INS service center physically receives the application, the 15-day clock starts. Within these 15 days, the INS guarantees to issue a decision, which is defined as either an approval, a notice of intent to deny, a request for more evidence, or a notice of investigation for fraud. If the INS fails to issue a decision within 15 calendar days, IMR's visa department will refund the $1000 premium-processing fee.

Combining IMR’s visa departments fast application preparation with the INS’ Premium Processing Service can mean getting decisions on your eligible applications in no more than 17 days after IMR’s visa department has all of the documents necessary to file with the INS:

  • 2 days for IMR’s visa department to get your application out to the INS

  • 15 days for the INS to issue a decision on the application
